The Donald T. administration is pushing for a fast-track review and boldly asking the Supreme Court to decide whether to hear the case by September 10 and schedule arguments in November. If the justices decline, the lower judiciary's ruling will take effect on October 14.
Another similar case, brought by American toy companies, is also set for review by the Supreme Court later this month. Both cases may force the justices to apply the “major questions doctrine,” a legal theory previously used to limit presidential power in other high-stakes cases.
