Americans vote today, November 3, 2026, in the US Midterms. They will decide all 435 House seats and 35 Senate seats. For crypto investors, the result matters beyond party politics. Congress controls digital asset laws, and two big issues remain open.
The CLARITY Act stalled in the Senate, and the SEC and CFTC are short on commissioners. Will a new balance of power bring clearer crypto rules, or another period of uncertainty?
Election date: November 3, 2026
House seats: All 435 are contested
Senate seats: 35 are contested
Main crypto concern: Market structure legislation
Regulators: SEC and CFTC
Key bill: CLARITY Act
Market focus: Bitcoin, XRP and Solana
Congress writes the laws that agencies enforce. The party in charge picks committee chairs, sets hearing schedules and decides which bills reach a vote.
For crypto, the House Financial Services Committee and the Senate Banking Committee matter most. Their leaders shape rules for exchanges, stablecoin issuers and blockchain firms.
Money is also flowing in. Public Citizen reported that corporate political giving reached $737.3 million this cycle, with crypto firms giving $233 million.
Note the difference between influence and impact. Voting today changes no rules and no prices by itself. It changes who holds power in 2027.

Analysts describe possible directions, not certain outcomes. Individual lawmakers and bipartisan deals will also shape results.
| Key Area | Democratic Control | Republican Control |
| Crypto regulation | Stronger consumer protection and oversight | More industry-friendly direction |
| CLARITY Act | Talks could grow harder | Better odds of renewed support |
| SEC oversight | More scrutiny of agency decisions | More continuity with the administration |
| Stablecoins | Tighter limits and safeguards | More support for industry growth |
| Crypto businesses | Higher compliance scrutiny | Focus on clarity and innovation |
Reuters reported that Democrats are also preparing investigations into crypto ventures linked to the Trump family.

The CLARITY Act aims to set clear market structure rules for digital assets. It would also divide duties between the SEC and the CFTC. The House passed it in July 2025. The Senate failed to advance it in a September vote, amid Democratic opposition, according to Reuters.
Control of Congress could shape the next attempt. A change in party control does not guarantee passage, though. The Senate still needs broad support, and bipartisan votes will decide the outcome. Until then, US crypto firms must work with unclear operating rules.
The SEC oversees securities, including some digital assets. The CFTC regulates derivatives and commodities markets. Forbes reports that the SEC has only two Republican commissioners and the CFTC has just one, despite rules calling for a bipartisan slate of five.
Last month, the SEC moved to make policy and enforcement decisions with a single commissioner. House Financial Services Chair French Hill says regulatory steps fall short and Congress must act. Congress also influences nominations and confirmations. Agency fixes can change quickly, so permanent law offers firms, exchanges and institutions more certainty.
Bitcoin (BTC): Economic data, ETF flows, liquidity and investor mood often matter more than one election. Analyst Ted Pillows noted that BTC fell about 51% after the 2018 midterms and about 25% after 2022. These are past observations. They do not prove elections caused the drops, and they do not predict 2026.
XRP: It is closely tied to US regulatory clarity, so market structure news could affect it most.
Solana (SOL): Regulation may shape institutional interest, investment products and ecosystem growth.

The US Midterms 2026 will decide who controls Congress, and that affects the CLARITY Act and the SEC and CFTC. Bitcoin, XRP and Solana may react differently. Readers should follow confirmed results and real policy steps, not predictions.
